General Terms and Conditions
1. Scope
The following Terms and Conditions (Terms) apply to all orders placed via our online shop.
These Terms also apply to businesses for future commercial relations without the need for any formal expression thereof. Unless expressly approved by us to the contrary, we cannot accept the contractual validity of any conflicting or complementary general terms and conditions used by any business.
2. Contractual partner, formation of contract, options for corrections
The contract is concluded with PLAION GmbH.
By placing the products in the online shop, we make a binding offer on our part to enter into a contract regarding those items. You may place our products in the shopping basket without obligation and amend your entries at any time prior to submitting your binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in the shopping basket. Once you have sent your order you will immediately receive a confirmation via e-mail.
3. Contract language, saving of the contract text
The language(s) available for concluding the contract: German, English
The text of the contract will not be saved by us.
4. Delivery conditions
Delivery costs may apply to the product prices displayed. Further information on delivery costs, if applicable, are explained within individual product offers.
We only dispatch goods en route; pick up by the customer is not possible.
We do not deliver to a "Packstation".
5. Payment
PayPal
In order to pay via PayPal, you must be registered with PayPal, legitimise yourself and confirm the payment instruction.
PayPal Plus
Payment via PayPal services. Further payment options may be offered by PayPal.
Amazon Pay
To pay using Amazon Pay, you must be registered and confirm the payment instruction.
6. Right to cancel
Consumers are entitled to the statutory right to cancel. Businesses are not granted any voluntary right to cancel.
7. Retention of title
The goods remain our property until full payment is made. Additional rules apply to businesses.
8. Damage during delivery
If goods are delivered with obvious transport damage, consumers should report this as soon as possible. Your legal rights remain unaffected.
Businesses must comply with the inspection and notification obligations of the Austrian Commercial Code (UGB).
9. Warranty and guarantees
9.1 Liability for defects
We are under a legal duty to supply products in conformity with this contract. Warranty rights according to consumer residence law apply.
9.2 Guarantees and customer service
Information about guarantees can be found next to the product or in the shop.
10. Liability
We are liable without limitation for injury to life, limb or health, and for deliberate or gross negligence.
In all other cases liability is limited to foreseeable direct damages.
11. Code of conduct
We adhere to the Trusted Shops code of conduct.
12. Trusted Shops Buyer Protection
You may insure orders up to 2500 EUR free of charge via Trusted Shops. Details can be found in the buyer protection conditions.
13. Online dispute resolution
The EU provides a platform for dispute resolution: https://ec.europa.eu/consumers/odr/
We will participate in such procedures if required.
14. Final provisions
Austrian law applies for businesses. Jurisdiction is the registered office of our company.
