EU Data Act Information

Below, we provide information pursuant to Article 3(2) of the EU Data Act (Regulation (EU) 2023/2854) regarding data generated through the use of certain retro products sold via the PLAION Retro Replai Store. PLAION acts solely as a retailer and is not the manufacturer and not the data holder.

1. Products covered

This information applies to retro consoles that allow saving game progress, settings or preferences on internal device memory. This information applies only under the following conditions:

  • no online connectivity
  • no external data transmission
  • no cloud services, user accounts or remote servers

2. Product data

When using the device, product-related data may be generated (e.g. locally stored save files or configuration settings). This data:

  • is stored exclusively on the device
  • is not transmitted to PLAION, the manufacturer or third parties
  • can be deleted or overwritten by the user directly on the device

3. Related service data

The devices sold via the PLAION Retro Replai Store do not generate related service data, as no online services, apps or connected digital services are used.

4. Use of data

As no external data transmission takes place, locally stored data is used solely by the user. Neither the manufacturer nor PLAION accesses or processes this data.

5. Data holder

The data holder is the respective manufacturer:

  • Atari
  • Retro Games Ltd. (Richco)

PLAION does not act as a data holder.

6. Data access

Users have direct and unrestricted access to all locally stored data via the device itself. No separate portals, interfaces or accounts are required. PLAION does not provide or manage data access.
